Data License Terms

These Data License Terms (“Data Terms”) govern your access to and use of data products provided by Tire Scouter (“Provider,” “we,” “us”). By accessing or using any Tire Scouter data product, whether through a data marketplace, direct delivery, or API, you (“Consumer,” “you”) agree to be bound by these Data Terms.
If you are accessing Tire Scouter data through a third-party marketplace (e.g., Snowflake Marketplace), the terms of that marketplace also apply. In the event of a conflict, the more restrictive term shall govern.
1. Definitions
- “Data Product” means any dataset, table, view, or derived data made available by Tire Scouter, including tire specifications, performance ratings, vehicle fitment data, and ScouterScore™ ratings.
- “Consumer” means any individual or entity that accesses a Data Product under these Data Terms.
- “Internal Use” means use within your organization for your own business operations, analytics, and decision-making.
- “Redistribution” means making all or a substantial portion of a Data Product available to a third party in raw or minimally transformed form.
2. License Grant
Subject to your compliance with these Data Terms, Tire Scouter grants you a non-exclusive, non-transferable, revocable license to access and use the Data Product for Internal Use. You may incorporate Data Product insights into your own products, reports, and services, provided you do not redistribute the underlying data in raw or substantially similar form.
3. Permitted Uses
You may:
- Query, analyze, and create derivative works from the Data Product for Internal Use.
- Use Data Product insights to enrich your own applications, dashboards, and reports.
- Combine the Data Product with your own or third-party data for analytical purposes.
- Share aggregated, non-identifiable insights derived from the Data Product with third parties.
4. Restrictions
You may not:
- Redistribute, resell, sublicense, or make the Data Product (or any substantial portion thereof) available to third parties.
- Use the Data Product to build a competing data product or service that replicates the Data Product’s core functionality.
- Reverse-engineer the ScouterScore algorithm or any proprietary methodology.
- Remove, obscure, or alter any proprietary notices, attribution, or branding included with the Data Product.
- Use the Data Product in any way that violates applicable law or regulation.
- Misrepresent the Data Product as your own original work.
5. Attribution
When publicly displaying insights derived from the Data Product, you must include a reasonable attribution to Tire Scouter (e.g., “Data provided by Tire Scouter” or “Source: tirescouter.com”). Attribution requirements may be modified or waived under a separate written agreement.
6. Data Quality & Disclaimers
Tire Scouter strives to provide accurate and current data. However, the Data Product is provided “as is” and “as available.” We make no warranties, express or implied, regarding the accuracy, completeness, timeliness, or fitness for a particular purpose of any Data Product.
The Data Product is not a substitute for professional advice. Tire performance can vary based on conditions not captured in the data. ScouterScore ratings are proprietary analytical outputs and do not constitute safety certifications or regulatory endorsements.
7. Intellectual Property
Tire Scouter retains all right, title, and interest in and to the Data Product, including all intellectual property rights. These Data Terms do not transfer ownership of any Data Product or underlying intellectual property. The ScouterScore methodology, proprietary algorithms, and curated data compilations are the intellectual property of Tire Scouter.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Tire Scouter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or reliance on any Data Product.
9. Termination
We may suspend or terminate your access to the Data Product at any time if you breach these Data Terms. Upon termination, you must promptly cease all use of the Data Product and destroy any copies in your possession, except to the extent that retention is required by law or the data has been incorporated into derivative works that do not themselves constitute Redistribution.
10. Modifications
We may update these Data Terms from time to time. Material changes will be communicated through the distribution platform or by updating this page. Continued use of the Data Product after changes are posted constitutes acceptance of the revised Data Terms.
11. Governing Law
These Data Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Data Terms shall be resolved in the courts of competent jurisdiction.
